Terms of Use

1. Acknowledgement and Acceptance of Terms

Please read the following terms carefully. By downloading, installing, accessing, or using "Poker Alpha" (hereinafter referred to as "this licensed application" or "this App"), you acknowledge that you have read, understood, and agree to be bound by all the contents of this "End User License Agreement and Terms of Service" (hereinafter referred to as "these Terms" or "EULA"). If you do not agree to any part of these Terms, please do not download, install, or use this App.

1.1 Scope of Application: These Terms are concluded solely between you (the "End User" or "you") and the Poker Alpha development team (the "Developer" or "we").

1.2 Relationship with Apple Inc.: This licensed application is exclusively the responsibility of the Developer (not Apple). The usage rules for the licensed application specified in these Terms must not conflict with the "Apple Media Services Terms and Conditions" in effect as of the effective date of these Terms (which you acknowledge having had the opportunity to review).

1.3 Terms Modification and Acceptance: We reserve the right to modify these Terms at any time. Modified Terms will be published within this App or on our official website and will take effect upon publication. For any significant changes that substantially affect user rights, we will make reasonable efforts to provide advance notice through in-app notifications, email, or other reasonable means. If you continue to use this App after the Terms have been modified, you will be deemed to have accepted the modified Terms.

2. Scope of License

2.1 Limited License Grant: The Developer grants you a limited, non-exclusive, non-transferable license to use this licensed application on any Apple-branded product that you own or control (such as iPhone, iPad), and only to the extent permitted by the "Usage Rules" set forth in the Apple Media Services Terms and Conditions.

2.2 Family Sharing and Volume Purchase Exception: This licensed application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing functionality.

2.3 Upgrades and Content Applicability: These Terms shall govern any content, materials, or services provided by this App (including items obtained through in-app purchases), as well as any upgrades provided by the Developer to replace or supplement the original App, unless such upgrade is accompanied by its own custom terms.

2.4 Usage Restrictions: You agree that you will not, and will not permit others to:

  • Distribute this App or make it available over a network where it could be used by multiple devices at the same time (except for Family Sharing and volume purchases).
  • Sell, resell, rent, lend, transfer, redistribute, or sublicense this App. If you sell your Apple device to a third party, you must remove this App from that device beforehand.
  • Copy this App (except as expressly permitted by this license and Usage Rules).
  • Reverse engineer, decompile, disassemble, attempt to derive source code, modify, or create derivative works of this App or any part thereof (except to the extent and only to the extent that applicable law prohibits such restrictions, or to the extent permitted by the licensing terms of any open source components included in this App).
  • Violate any applicable laws or regulations.
  • Infringe upon our intellectual property rights or those of any third party.
  • Upload or transmit any content containing viruses, malware, or harmful code.
  • Engage in any behavior that could damage, disable, overburden, or impair the normal operation of this App.
  • Use any automated tools (such as bots, crawlers) to extract, monitor, or copy any content or data from this App in bulk, unless you have obtained our prior written consent.

3. Service Features

Poker Alpha is a professional tool designed specifically for Texas Hold'em poker players, providing the following main services:

3.1 Basic Version Features:

  • Quick Hand Recording: Intuitive interface for easily inputting game information from pre-flop to river.
  • Basic Hand Record and Review: Your hand records will be securely stored in the App and can be reviewed anytime (may have quantity limitations).
  • Limited AI Analysis and Strategy Suggestions: Daily limited AI analysis providing basic analysis and action recommendations through AI.
  • Diversified Sharing Tools (partial features): Supports copying hand text for easy discussion with others.

3.2 Premium Subscription Service:

  • Unlimited Hand Recording and Storage: Unlock unlimited hand recording and analysis.
  • AI Professional Deep Analysis: Through advanced AI engine, provides in-depth analysis based on Game Theory Optimal (GTO) solutions, identifying strengths and weaknesses with precise decision recommendations.
  • Diversified Sharing Tools (complete features): Besides copying hand text, automatically converts hand records into beautiful visual images, supports downloading to device gallery for easy sharing on social platforms.
  • May receive priority access to future new features.

We reserve the right to modify, suspend, or terminate some or all services of this App (including both Basic and Premium features), change functionality, or adjust pricing at our sole discretion, with or without prior notice. We will make reasonable efforts to provide advance notice of significant changes, but have no obligation to do so.

4. Service Nature and Compliance Statement

4.1 Educational Purpose Statement: Poker Alpha is an educational and learning-oriented auxiliary tool focused on poker strategy analysis and skill improvement. This App does not involve, promote, or support any form of real money gambling activities.

4.2 Usage Limitations: This App is solely for analyzing hands, learning strategic thinking, and technical exchange, and must not be used to assist or participate in any gambling activities. We encourage users to learn and enjoy poker games in legal and healthy environments.

4.3 User Responsibility: Users shall ensure that their use of this App complies with local laws and regulations, and promise not to use this App for any illegal gambling activities.

5. Subscription, Payment, and Renewal

5.1 Subscription: You may subscribe to Premium services within this App through the Apple App Store. We offer both monthly and annual subscription plans, with specific prices as displayed in the App Store.

5.2 Payment Method: Subscription fees will be charged to your iTunes account when you confirm the purchase.

5.3 Auto-Renewal Mechanism: Your subscription will automatically renew unless you turn off auto-renewal in your iTunes account settings at least 24 hours before the end of the current subscription period.

5.4 Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current subscription period, at the same amount as your initial subscription (unless the price changes, in which case advance notice will be provided).

5.5 Subscription Management: You can manage your subscription and turn off auto-renewal by going to your iTunes account settings after purchase.

5.6 Refund Policy: All refund requests must be processed through Apple App Store's standard procedures. According to App Store policy, we typically do not provide refunds for partially used subscription periods.

6. Data Usage and Privacy

6.1 User Content (Hand Data):

  • User Responsibility: You represent and warrant that you have the legal right to input, store, and process all hand information you enter through this App. You may not use this App to input or store any personal information you do not have the right to process.
  • Prohibited Misuse: You agree not to use any hand information obtained or stored through this App for illegal purposes, harassment, unsolicited commercial promotion (spam), or any behavior that violates others' privacy.
  • Data Ownership: You own the hand data you input and store.
  • License Grant: To enable this App to provide its functionality (such as storage, search, analysis), you grant us a necessary, worldwide, royalty-free, non-exclusive license to store, process, display, and manage the hand data you input or scan within this App. This license is solely for providing and improving the App services as needed.

6.2 AI Function Usage:

  • AI Model Application: This App may use generative AI models to assist in hand analysis, strategy suggestions, or information extraction.
  • Cross-border Data Processing Commitment: We commit that services outside mainland China will not use generative AI models located in mainland China for data processing.
  • AI Accuracy Disclaimer: AI analysis and processing results may contain errors or inaccuracies and are for reference only. You should independently verify and evaluate analysis results, and we are not responsible for any consequences resulting from analysis errors.

6.3 Technical Data Collection: You agree that we may collect and use anonymous technical data and related information (including but not limited to technical information about your device, system, and application software and peripherals), which is periodically collected to facilitate providing software updates, product support, and other services related to this App (if any). As long as this information is in a form that does not personally identify you, we may use it to improve our products or provide services or technology to you.

6.4 Privacy Policy: How we collect, use, store, and protect your personal information (including hand data and technical data) is governed by our Privacy Policy, which forms part of these Terms. Please be sure to review our Privacy Policy for detailed information.

7. Intellectual Property Rights

7.1 App Ownership: This App itself and all related rights, including but not limited to source code, object code, interface design, visual elements, graphics, icons, trademarks, text content, functionality, and all related intellectual property rights, are the exclusive property of the Developer or its licensors. These Terms do not grant you any ownership rights in this App.

7.2 Third-Party Content and Services: This App may use or integrate third-party services, libraries, or content (such as Firebase, AI models, etc.). The rights to these third-party components belong to their respective owners, and their use may be subject to corresponding third-party terms.

The service and all its content, including but not limited to text, graphics, logos, images, audio, video, software, and design, are protected by copyright, trademark, and other intellectual property laws. Without our prior written consent, you may not copy, modify, distribute, transmit, or publicly display any content.

8. Service Changes, Suspension, and Termination

8.1 Service Change Rights: We reserve the right to modify, suspend, or terminate some or all services of this App (including both Basic and Premium features), change functionality, or adjust pricing at our sole discretion, with or without prior notice. We will make reasonable efforts to provide advance notice of significant changes, but have no obligation to do so.

8.2 User Termination:

  • You may stop using the Basic version of this App at any time.
  • Premium subscription users may cancel their subscription through the App Store as described in Section 5.5. After cancellation, Premium features will expire at the end of the current subscription period, and your App will revert to Basic version status.

8.3 Developer Termination Rights: If you fail to comply with any provision of these Terms, your rights under these Terms will automatically terminate without further notice from us. In addition, we reserve the right to suspend or terminate your access to this App or services at our sole discretion in the following situations:

  • You violate these Terms or applicable laws and regulations.
  • You engage in any illegal, fraudulent, or abusive behavior.
  • For technical, security, legal, or business reasons, we deem it necessary to terminate services.
  • At the request of government or regulatory authorities.

8.4 Consequences of Termination: Upon termination of these Terms, you must stop all use of this App and delete this App from all your devices. After service termination (whether initiated by you or us), we may handle your data according to the data retention policy described in the Privacy Policy (for example, providing limited-time export functionality for Premium users, followed by data deletion). Please note that Section 7 (Intellectual Property Rights), Section 10 (Warranties and Disclaimers), Section 11 (Product Claims), Section 12 (Limitation of Liability), and other provisions that by their nature should continue in effect, will remain in effect after termination of these Terms.

9. Maintenance and Support

9.1 Developer Responsibility Scope: The Poker Alpha development team is exclusively responsible for providing any maintenance and support services for this App as specified in these Terms or required by applicable law.

9.2 Apple Disclaimer: You and the Poker Alpha development team acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to this App.

10. Warranties and Disclaimers

10.1 Developer Warranty Responsibility: The Poker Alpha development team is exclusively responsible for addressing any product warranties, whether express or implied by law, except to the extent effectively disclaimed in these Terms.

10.2 "As Is" Provision Disclaimer: You expressly acknowledge and agree that use of this App is at your sole risk. To the maximum extent permitted by applicable law, this App and any services performed or provided by this App are provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. The Developer hereby disclaims all warranties and conditions with respect to this App and any related services, whether express, implied, or statutory.

10.3 Apple's Limited Refund Responsibility: These Terms provide that if this App fails to conform to any applicable warranty (to the extent not effectively disclaimed above), the End User may notify Apple, and Apple will refund the purchase price of this App (if any was paid) to that End User.

10.4 Apple's Further Disclaimer: To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to this App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of the Developer.

10.5 Service Functionality Not Guaranteed: We do not guarantee that the functionality of this App will meet your requirements, that its operation will be uninterrupted or error-free, that the service will be continuously available, or that defects will be corrected.

10.6 AI Recognition Accuracy Not Guaranteed: We provide no warranty regarding the accuracy, completeness, or timeliness of AI analysis results. You bear full responsibility for any decisions made or actions taken based on such information.

10.7 Data Loss Disclaimer and Backup Recommendation: We are not responsible for any data loss or corruption resulting from the use or inability to use this App. We strongly recommend that you regularly back up important hand data stored in this App yourself.

10.8 Applicability to Specific Jurisdictions: Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights for consumers, so the above exclusions and limitations may not apply to you.

11. Product Claims

11.1 Developer Claim Handling Responsibility: You and the Poker Alpha development team acknowledge that the Developer, and not Apple, is responsible for addressing any claims of you or any third party relating to this App or your possession and/or use of this App, including but not limited to: (i) product liability claims; (ii) any claim that this App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11.2 Liability Limitation: This Terms' limitation on the Developer's liability to End Users shall not exceed the extent permitted by applicable law.

12. Limitation of Liability

12.1 Indirect Damage Disclaimer: To the extent not prohibited by law, in no event shall the Developer be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, arising from your use of or inability to use this App, regardless of the cause and regardless of the theory of liability (contract, tort, or otherwise), even if the Developer has been advised of the possibility of such damages. These damages include but are not limited to: loss of profits, data loss or corruption, business interruption, any business damages or losses resulting from hand information analysis errors, or any other commercial damages or losses.

12.2 Applicability to Specific Jurisdictions: Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.

12.3 Complete Disclaimer: To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use this App (except as may be required by applicable law in cases involving personal injury). This disclaimer applies to all theories of liability, including but not limited to contract, tort, negligence, or strict liability, even if the Developer has been advised of the possibility of such damages.

13. Intellectual Property Rights Claims

13.1 Developer Claim Handling Responsibility: You and the Poker Alpha development team acknowledge that, in the event of any third-party claim that this App or the End User's possession and use of this App infringes that third party's intellectual property rights, the Developer, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

14. Legal Compliance

14.1 US Government Compliance: You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

15. Third-Party Agreement Terms

15.1 Compliance with Third-Party Terms: When using this App, you must comply with applicable third-party agreement terms. For example, when using this App, you must not violate your wireless data service agreement.

16. Third-Party Beneficiary

16.1 Apple as Third-Party Beneficiary: You and the Poker Alpha development team acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

17. Governing Law and Dispute Resolution

17.1 Governing Law: The interpretation and application of these Terms, and any disputes or claims arising from or related to these Terms, shall be governed by the laws of the Republic of China (Taiwan), excluding its conflict of laws principles.

17.2 Dispute Resolution and Jurisdiction: For any disputes arising from or related to these Terms, the parties shall first attempt to resolve them through amicable negotiation. If negotiation fails, both parties agree that the Taipei District Court in Taiwan shall have exclusive jurisdiction for the first instance.

20. General Provisions

20.1 Entire Agreement: These Terms and the referenced Privacy Policy constitute the complete agreement between you and the Developer regarding the use of this App, and supersede all prior or contemporaneous oral or written agreements on this subject.

20.2 Severability: If any provision of these Terms is determined by a court of competent jurisdiction to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

20.3 Waiver: The Developer's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
